1. Introduction

These Terms and Conditions (“Terms”) apply to all bookings, purchases, and participation in physical sporting activities and related services (“Services”) provided by Summer Ice (“we”, “us”, “our”). By purchasing or participating in our Services, you agree to these Terms, which are governed by Dutch consumer law, including the Burgerlijk Wetboek (Dutch Civil Code) and applicable EU consumer protection regulations.

2. Services

  • Summer Ice organizes and delivers physical sporting activities, training sessions, workshops, and related services.

  • Details of each Service, including schedules, locations, and participation requirements, are provided at the time of booking.

  • We may modify or update Services when necessary (e.g., due to weather, safety concerns, or instructor availability). Any significant changes will be communicated promptly.

3. Booking and Payment

  • A booking is confirmed once full payment or an agreed‑upon deposit has been received.

  • Prices are listed on our website or promotional materials and may be updated periodically.

  • You are responsible for ensuring that all information provided during booking is accurate.

4. Right of Withdrawal (Herroepingsrecht)

In accordance with Dutch consumer law (Articles 6:230o–6:230s BW), you have the legal right to withdraw from your purchase within 14 days of completing your booking (“Cooling‑Off Period”).

4.1 Refunds During the Cooling‑Off Period

  • If you withdraw within the Cooling‑Off Period and no sessions have taken place, you will receive a full refund.

  • If you withdraw within the Cooling‑Off Period after one or more sessions have already occurred, a pro‑rated amount will be deducted from your refund. This deduction reflects the portion of the Service already delivered, as permitted under Article 6:230s BW.

4.2 Pro‑Rated Calculation

  • The deduction is based on the number of sessions already provided relative to the total number of sessions purchased.

  • Example: If you purchased 10 sessions and attended 2 before withdrawing, you will be refunded the value of the remaining 8 sessions.

5. Cancellations After the Cooling‑Off Period

  • Cancellations made after the 14‑day Cooling‑Off Period are non‑refundable unless otherwise stated in the specific Service description.

  • In exceptional circumstances (e.g., medical issues), we may consider partial refunds or credits at our discretion, though this is not required under Dutch law.

6. Participant Responsibilities

  • You must ensure you are physically able to participate in the activities.

  • You agree to follow all safety instructions provided by Summer Ice staff.

  • Appropriate clothing, footwear, and equipment must be used as required.

7. Health and Safety

  • Participation in physical activities carries inherent risks. By joining our Services, you acknowledge and accept these risks.

  • Summer Ice is not liable for injuries resulting from failure to follow instructions, misuse of equipment, or pre‑existing health conditions.

8. Liability

  • Summer Ice is not responsible for loss, theft, or damage to personal belongings.

  • Our liability for any claim arising from the Services is limited to the amount paid for the specific Service, except where such limitation is not permitted under Dutch law.

9. Changes to Terms

We may update these Terms from time to time. The version in effect at the time of your booking will apply to your purchase.
